The agreement
These terms are between Artygroup LLC (“Confetti Cam”, “we”) and you. “Hosts” buy an event package and control an event; “guests” participate via an event link or QR code. Guests are bound by the Guest Terms, which incorporate the relevant parts of these terms.
1. The service
Confetti Cam provides a digital disposable camera for private events: guests capture a limited number of photos and videos through our web or iOS experience, and the media is collected into a private album for the host, in both original and filtered versions.
2. Accounts
Hosts create an account with a valid email and are responsible for activity on it. You must be at least 18 to be a host. Accounts can be deleted at any time in the dashboard or app, or via privacy@confetti.cam.
3. Purchases, and what you get
- Event packages are one-time purchases, priced by guest-count tier, payable on our website. What each tier includes is stated at purchase.
- Your event’s media is stored for 12 months from the event date (“the retention window”). We remind you before it ends. Download everything before expiry; after expiry, media is permanently deleted.
- Refunds: full refund any time before your event date. After the event has begun, fees are non-refundable (the service has been performed) — except that if a verified failure of our service causes the loss of captured media, you are entitled to a full refund.
- Prices may change; changes never affect an already-purchased event.
4. Acceptable use
You and your guests may not use Confetti Cam to capture, upload, or share content that is unlawful, infringing, sexually explicit, exploitative of minors, harassing, or malicious (including malware or attempts to break the service). We may remove content, suspend guests’ access, or (for serious or repeated violations) suspend an account. We report child sexual abuse material to the authorities as required by law.
5. Your content: ownership and licenses
- Ownership never moves. Guests own the photos and videos they capture. Hosts own nothing they didn’t create — but they receive the license below. Confetti Cam owns none of your content.
- Guests grant the host a perpetual, worldwide, royalty-free license to use, reproduce, display, share, and print the media they captured at the host’s event, for personal, non-commercial purposes.
- Guests and hosts grant Confetti Cam a limited license to host, store, reproduce, process (for example, apply filters, create thumbnails and playable versions), and transmit event media solely to operate and improve the service. This license ends when the media is deleted, except for copies in routine backups that age out within 30 days.
- We will never sell your media, license it to third parties, use it in our marketing without your explicit written permission, or use it to train machine-learning models.
- Hosts control the album: curation (hiding), sharing, and deletion. Guests’ rights to request deletion of their own captures are described in the Privacy Policy.
6. The host's responsibilities
Hosts warrant that they have the right to upload their guest list, will use it only for their event, and will tell their guests photos are being collected. The printed table cards we provide carry that notice by default.
7. Moderation and reports
Anyone with album access can report content. Reported content is hidden pending review; we aim to act on reports within 24 hours. We may remove content that violates §4 without prior notice. Copyright complaints: dmca@confetti.cam.
8. Service availability — read this section
We build for reliability above all — capture works offline and nothing is confirmed “saved” until it is safely stored. But no online service can guarantee perfection, and a wedding cannot be re-run:
- The service is provided “as is” and “as available”; we disclaim implied warranties to the extent the law allows.
- We do not guarantee that every guest’s device, browser, or network will successfully capture or upload media, or that any particular guest will participate.
- We strongly recommend the host also hires a professional photographer. Confetti Cam is a candid supplement, never a replacement.
9. Liability cap
To the maximum extent permitted by law: our total liability for all claims relating to an event is capped at the amount you paid for that event, and neither party is liable for indirect, incidental, or consequential damages, including emotional or sentimental value of lost media. Some jurisdictions don’t allow these limits; where so, they apply to the fullest extent permitted. Nothing here limits liability that cannot lawfully be limited (for example, gross negligence or willful misconduct).
10. Indemnity
Hosts indemnify us against third-party claims arising from their event content or their breach of these terms (for example, a guest-list upload they had no right to make), to the extent permitted by law.
11. Termination
We may suspend or terminate for material breach. You may stop using the service at any time; §3’s refund terms govern money, and the Privacy Policy governs data deletion.
12. Boring but important
Governing law: California; venue: Los Angeles County. These terms, the Guest Terms, and the Privacy Policy are the entire agreement. If a clause is unenforceable, the rest stands. We may update these terms; material changes are emailed to hosts and apply 30 days later — changes never reduce what an already-purchased event includes.
